By accessing or using My Digital Assistant (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part, you may not access the Service.

2. Description of the Service

My Digital Assistant provides an AI-based virtual assistant that can be integrated into websites to interact with visitors through voice and text conversations.

3. Account Registration

3.1 Eligibility

  • You must be at least 18 years old
  • You must provide accurate information
  • You are responsible for the security of your account

3.2 Account Security

  • Keep your password confidential
  • Immediately report any unauthorized access
  • You are responsible for all account activity

4. Subscription Plans and Payment

4.1 Plans

  • Starter: €19/month – 1 hour of conversations
  • Pro: €49/month – 4 hours of conversations
  • Business: €99/month – 10 hours of conversations

4.2 Payment Terms

  • Monthly or annual billing
  • Automatic renewal
  • Prices exclude VAT where applicable
  • Payment via Stripe

4.3 Refunds

  • 30-day money-back guarantee for new customers
  • No refunds for partial months
  • Refunds at our discretion for technical issues

5. Acceptable Use Policy

You agree NOT to:

  • Use the Service for illegal purposes
  • Transmit malicious code or malware
  • Violate intellectual property rights
  • Harass, abuse, or harm others
  • Attempt unauthorized access
  • Resell the Service without permission
  • Use it for spam or unsolicited messages
  • Impersonate others
  • Collect personal data without consent

6. Intellectual Property

6.1 Our Property

  • The Service and its content are our property
  • You may not copy, modify, or decompile
  • Our trademarks remain our property

6.2 Your Content

  • You retain ownership of your content
  • You grant us a license to use content for the Service
  • You are responsible for the legality of your content

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS OR REVENUE
  • DAMAGES EXCEEDING FEES PAID IN THE LAST 12 MONTHS

12. Indemnification

You agree to indemnify us against claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your content
  • Your violation of others’ rights

13. Governing Law

These Terms are governed by Italian law. Disputes will be resolved in the courts of Milan, Italy.

14. Changes to the Terms

We may update these Terms. Material changes will be notified 30 days in advance.
